The NHTSA has developed the following car seat and booster seat recommendations for children up to 12 years old:
- Birth to 12 Months: Should remain in a rear-facing car seat placed in the back seat of the vehicle
- 1 to 3 Years: Should remain in a rear-facing car seat for as long as possible but can transition to a front-facing car seat when necessary due to weight or height
- 4 to 7 Years: Should remain in a forward-facing car seat until they reach the height or weight limits, then transition to a booster seat in the back seat
- 8 to 12 Years: May transition to a seat belt system without a booster seat if they are tall enough to fit the system properly
Even once they are tall enough to wear a proper seat belt, your child should still sit in the back seat whenever possible.
What Are The Car Seat Laws In Tennessee?
According to Tennessee state law, the driver of a vehicle is responsible for ensuring that passengers under 16 years of age are properly restrained. If you fail to do so, you can receive a fine of $50 per violation.
Like the NHTSA, Tennessee also uses age brackets when addressing restraint requirements, but some of the brackets have different beginning and ending ages, as well as alternative height and weight requirements.
These brackets are as follows:
- Birth to One Year of Age (or < 20 Pounds): Must be transported in a rear-facing car seat
- 1 to 3 Years of Age (and > 20 pounds): Must be secured in a forward-facing car seat
- 4 to 8 Years of Age (and Under 4’9”): Must be secured in a booster seat
- 9 to 12 Years of Age: Must wear a seat belt and should sit in the back seat if you have one available
It’s important to note the difference between laws and recommendations. NHTSA guidelines are recommendations, which means you aren’t legally required to follow them despite their intent to promote child safety. Tennessee laws are just that — laws. They are enforceable, which in turn means you can get a ticket if you don’t comply.
